By using the Attraction Flow website (the "Site") and/or any information provided to Attraction Flow customers on Attraction Flow CRM, Attraction Flow scripts, material, text, videos, and information Attraction Flow makes available to customers through subscription to Attraction Flow CRM or other third-party site (collectively “AF Information”), you agree to follow and be bound by these terms of use (the "Terms of Use") and agree to comply with all applicable laws and regulations. In these Terms of Use, the words "you" and "your" refer to each customer, Site visitor, or AF Information user, "we", "us" and "our" refer to Attraction Flow, LLC and "Services" refers to all services provided by us.

It is your responsibility to review these Terms of Use periodically. We may revise these Terms of Use at any time without notice to you.

1. Fulfillment policies: No Refunds.
All sales are final, and the Company does not offer any money-back guarantees.

2. Privacy Policy.
Attraction Flow respects your privacy and permits you to control the treatment of your personal information. A complete statement of Attraction Flow's current Privacy Policy can be found by clicking here. Attraction Flow's Privacy Policy is expressly incorporated into this Agreement by reference.

3. User Name and Passwords.
When you register an account to access AF Materials, you must provide complete and accurate information as requested on the registration form. You will also be provided with a user name and password. You are entirely responsible for maintaining the confidentiality of your password and may not share the user name or password with any other individual or entity.

You may not use a third party's account, user name, or password at any time. You agree to notify Attraction Flow immediately of any unauthorized use of your account, user name or password. Attraction Flow shall not be liable for any losses you incur as a result of someone else's use of your account or password, either with or without your knowledge. You may be held liable for any losses incurred by Attraction Flow, our affiliates, officers, directors, employees, consultants, agents and representatives due to someone else's use of your account or password.

4. Attraction Flow CRM Subscription.
To fully utilize Attraction Flow’s proprietary system, a monthly subscription to Attraction Flow CRM is required.
Attraction Flow customers must subscribe to Attraction Flow CRM using the link Attraction Flow provides to the customer after purchase of the Attraction Flow system.

5. Attraction Flow Material.
Attraction Flow’s products and services are delivered to the customers on AttractionFlow.com and Attraction Flow CRM. All Attraction Flow information, including but not limited to, text, scripts, templates, graphics, logos, icons, images, flow charts, ideas, site functionality, processes, sounds and videos (“AF Material”) is included in and governed by these Terms of Use without regard to whether the material is accessed on this Site or Attraction Flow CRM.
The term “AF Material” as used herein includes Attraction Flow content and material on both websites.

6. Access to Training Calls.
By purchasing the Attraction Flow system, you become eligible by invitation to participate in certain Zoom calls that may be, but are not required to be, offered from time to time by Eric Orland and/or Jeff Setlow or their agents.
The consideration paid by Attraction Flow customers obligates Attraction Flow to provide access to Attraction Flow’s directions, scripts, templates, videos, and other information contained on its website and integrated into Attraction Flow CRM.

7. Ownership and Copyright.
All content and functionality on this site and AF Material on crmgrow, including text, templates, graphics, logos, icons, images, flow charts, sounds and videos, and the selection and arrangement thereof, in addition to any concepts, know-how, tools, frameworks, software, applications or other technology, algorithms, models, processes, and industry perspectives underlying or embedded in the foregoing, along with any enhancements to or derivative works thereof is the exclusive property of Attraction Flow and, to the extent applicable, is protected by U.S. and international copyright laws.

Except as otherwise expressly provided by Attraction Flow, no AF Material may be copied, reproduced, republished, downloaded, uploaded, posted, displayed, transmitted or distributed in any way, and nothing on this Site or on any AF Material shall be construed to confer any license under any of Attraction Flow's intellectual property rights, whether by estoppel, implication or otherwise. Any rights not expressly granted herein are reserved by Attraction Flow.

AF Material, including site content and functionality, may not be copied, reproduced, downloaded, posted, modified, reverse engineered, altered (including the removal or disabling of any security or technological safeguards, disclaimers, or legends) uploaded, published, posted, transmitted, or distributed in any way without our written permission, except for those uses specified in Paragraph 7 of this Terms of Use Agreement.
All rights not expressly granted are reserved.

8. Limited License to Use.
Attraction Flow grants you a limited, personal, non-exclusive, non-transferable license to view and use A including scripts, text, and other written information for your own personal, internal business use. This license applies only to the customer who purchased the Attraction Flow system and may not be used as a tool for agent recruitment by any other person. Except as otherwise provided, you acknowledge and agree that you have no right to modify, edit, copy, reproduce, create derivative works of, reverse engineer, alter, enhance or in any way exploit any of the Information in any manner. You shall not remove any copyright notice from any AF Materials.

This permission terminates automatically without notice if you breach any of the terms or conditions of these Terms of Use. On any such termination, you agree to immediately destroy any downloaded or printed Materials. Any unauthorized use of any Materials contained on this Site or onAttraction Flow CRM may violate copyright laws, trademark laws, laws of privacy and publicity and communications regulations and statute

9. Additional Terms.
Some Attraction Flow Services may be subject to additional posted guidelines, rules or terms of service ("Additional Terms") and your use of such Services will be conditioned on your agreement to the Additional Terms. If there is any conflict between these Terms of Use and the Additional Terms, the Additional Terms will control for that Service, unless the Additional Terms expressly state that these Terms of Use will control.

10. NO WARRANTY.
THE SITE AND ALL AF MATERIAL PROVIDED ON OR THROUGH YOUR USE OF THE SITE OR ATTRACTION FLOW CRM ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, ATTRACTION FLOW EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

ATTRACTION FLOW MAKES NO WARRANTY THAT: (A) THE SITE, AF MATERIAL, OR THE MATERIALS WILL MEET YOUR REQUIREMENTS; (B) THE SITE, AF MATERIAL, OR THE MATERIALS WILL BE AVAILABLE ON AN UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE BASIS; (C) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SITE, AF INFORMATION, OR ANY MATERIALS OFFERED THROUGH THE SITE OR AF INFORMATION, WILL BE ACCURATE OR RELIABLE; OR (D) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SITE, AF INFORMATION, OR IN RELIANCE ON THE MATERIALS WILL MEET YOUR EXPECTATIONS.OBTAINING ANY MATERIALS THROUGH THE USE OF THE SITE OR AF INFORMATION IS DONE AT YOUR OWN DISCRETION AND AT YOUR OWN RISK. ATTRACTION FLOW SHALL HAVE NO RESPONSIBILITY FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY CONTENT, MATERIALS, INFORMATION OR SOFTWARE.

11. LIMITATION OF LIABILITY AND INDEMNIFICATION.
EXCEPT AS PROHIBITED BY LAW, YOU WILL HOLD ATTRACTION FLOW AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS HARMLESS FOR ANY INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGE, HOWEVER IT ARISES (INCLUDING ATTORNEYS' FEES AND ALL RELATED COSTS AND EXPENSES OF LITIGATION AND ARBITRATION, OR AT TRIAL OR ON APPEAL, IF ANY, WHETHER OR NOT LITIGATION OR ARBITRATION IS INSTITUTED), WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE, OR OTHER TORTIOUS ACTION, OR ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT, INCLUDING WITHOUT LIMITATION ANY CLAIM FOR PERSONAL INJURY OR PROPERTY DAMAGE, ARISING FROM THIS AGREEMENT AND ANY VIOLATION BY YOU OF ANY FEDERAL, STATE, OR LOCAL LAWS, STATUTES, RULES, OR REGULATIONS, EVEN IF ATTRACTION FLOW HAS BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. EXCEPT AS PROHIBITED BY LAW, IF THERE IS LIABILITY FOUND ON THE PART OF ATTRACTION FLOW, IT WILL BE LIMITED TO THE AMOUNT PAID FOR THE PRODUCTS AND/OR SERVICES, AND UNDER NO CIRCUMSTANCES WILL THERE BE CONSEQUENTIAL OR PUNITIVE DAMAGES. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE PRIOR LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
THIS PARAGRAPH DOES NOT APPLY TO NORTH CAROLINA CONSUMERS.

12. Compliance with Intellectual Property Laws.
When accessing Attraction Flow or using AF Material, you agree to obey the law and you agree to respect the intellectual property rights of others. Your use of the Service and the Site is at all times governed by and subject to laws regarding copyright, trademark and other intellectual property ownership. You agree not to upload, download, display, perform, transmit or otherwise distribute any information or content in violation of any copyrights, trademarks or other intellectual property or proprietary rights. You agree to abide by laws regarding copyright ownership and use of intellectual property, and you shall be solely responsible for any violations of any relevant laws and for any infringements of third party rights caused by any content you provide or transmit or that is provided or transmitted using your Attraction Flow user account.

13. Personal Use.
The site is made available for your personal use on your own behalf.

14. Governing Law; Venue.
These Terms are governed by the laws of the State of Arizona, without regard to the principles of conflicts of laws thereof.

Any legal action or proceeding relating to your access to or use of the Site or AF Materials is governed by the Arbitration Agreement contained in paragraph 6 of these Terms of Use. These Terms of Use expressly exclude and disclaim the terms of the U.N. Convention on Contracts for the International Sale of Goods, which shall not apply to any transaction conducted through or otherwise involving this Site or an Application.
The exclusive jurisdiction for all disputes will be Maricopa County, Arizona, and you and/or your company each waive any objection to jurisdiction and venue in such courts.

15. Dispute Resolution.

a. Mandatory Arbitration of Disputes. We each agree that any dispute, claim or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation or validity thereof or the use of the Services (collectively, “Disputes”) will be resolved solely by binding, individual arbitration and not in a class, representative or consolidated action or proceeding. You and Company agree that the U.S. Federal Arbitration Act governs the interpretation and enforcement of these Terms and that you and Company are each waiving the right to a trial by jury or to participate in a class action. This arbitration provision shall survive termination of these Terms.

b. Exceptions. As limited exceptions to Section 14(a) above: (i) we both may seek to resolve a Dispute in small claims court if it qualifies; and (ii) we each retain the right to seek injunctive or other equitable relief from a court to prevent (or enjoin) the infringement or misappropriation of our intellectual property rights.

c. Conducting Arbitration and Arbitration Rules. The arbitration will be governed by the Consumer Arbitration Rules (the “AAA Rules”) then in effect, except as modified by these Terms. The AAA Rules are available at www.adr.org or by calling 1-800-778-7879. A party who wishes to start arbitration must submit a written Demand for Arbitration to AAA and give notice to the other party as specified in the AAA Rules. Any arbitration hearings will take place in Maricopa County, Arizona.

16. Acknowledgment.
BY USING ATTRACTION FLOW'S SERVICES OR ACCESSING THE ATTRACTION FLOW SITE OR AF INFORMATION, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF USE AND AGREE TO BE BOUND BY THEM.
